The actions of Operation Dudula at hospitals and schools were declared illegal.

The Johannesburg High Court ruled Tuesday that Operation Dudula has neither the authority nor the jurisdiction to bar undocumented foreign nationals from attending public schools or receiving medical care.

On behalf of several groups, the Socio-Economic Rights Institute of South Africa filed the lawsuit.

The movement’s actions—harassment, intimidation, and targeting of migrants—are cited in the case.

The court decided in favor of SERI, declaring that the activities of Operation Dudula were xenophobic and illegal.

They have been prohibited from obstructing clinics and schools by the Johannesburg High Court.

“This is a wonderful occasion, not only for our clients but for the South African constitution,” stated Nkosinathi Sithole, the litigation director at SERI.

“Given what we have been witnessing, Operation Dudula’s heinous criminal behavior of barring individuals from accessing healthcare, educational, and public facilities, as well as requesting identifying documents from them, has been deemed illegal and has been prohibited from doing so.”

In addition to discussing Operation Dudula, the court also discussed the state. The Minister of Home Affairs and the Minister of Police must also ensure that they are not complacent in the actions of Operation Dudula.

“The state cannot just go into people’s houses and begin conducting raids,” Sithole stated. Both an arrest warrant and a search warrant are required. They must have a strong, plausible suspicion that someone is an unauthorized foreign national in public.
