Welcome to Ezendawo – Local News South Africa (“we”, “us”, “our”, “Ezendawo”). By accessing or using our website (the “Site”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, do not use or access the Site.
1. Scope
1.1 These Terms apply to your use of the Site, including all content, features, functionalities, and services offered via the Site.
1.2 Additional terms may apply to specific services (e.g. subscriptions, premium content, advertising) and where there is conflict, those additional terms prevail for that service.
1.3 We may update or modify these Terms at any time. The updated version will take effect once posted on the Site. Your continued use after changes constitutes acceptance of the new Terms.
2. Eligibility & Access
2.1 You warrant that you are at least 18 years old (or of legal capacity in your jurisdiction) and capable of forming binding contracts.

4. User-Generated Content & Conduct
4.1 Where the Site allows user contributions (e.g. comments, submissions), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, adapt, distribute, publish, display, and create derivative works from your submissions in any medium.
4.2 You agree not to post content that is unlawful, defamatory, obscene, infringing, threatening, abusive, or otherwise objectionable.
4.3 We reserve the right to remove, edit, or refuse to post any content, and to suspend or terminate the accounts of users who violate these Terms.
5. Disclaimers & Limitations of Liability
5.1 No warranties. The Site and all content are provided “as is” and “as available” without warranties, express or implied. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, or security.
5.2 Limitation of liability. To the fullest extent permitted by law, we and our officers, agents, employees and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary loss or damage — including loss of profit, data, business or goodwill — arising out of or in connection with your use of the Site, even if we are advised of the possibility of such damages.
5.3 Force majeure. We will not be liable for delays or failures due to events beyond our reasonable control (e.g. natural disasters, power outages, acts of government, cyber‑attack).

6.1 The Site may contain links to third‑party websites, products, or services. Those links are provided for convenience only, and we do not endorse, control, or guarantee them.
6.2 We are not responsible for content, privacy practices, or liabilities of third‑party sites. Use them at your own risk.
7. Privacy & Personal Information
7.1 Our handling of personal information is governed by a separate Privacy Policy which forms part of these Terms.
7.2 By using the Site, you consent to collection, use, processing, and storage of personal information as outlined in our Privacy Policy, and in accordance with the Protection of Personal Information Act (POPIA).
8. Electronic Communications & Transactions
8.1 When you communicate with us electronically (e.g. by email), you consent to receiving communications in electronic form. Such communications satisfy any legal requirement for “written” notices.

9.1 You agree not to use the Site for any unlawful or prohibited purpose.
9.2 You must not engage in:

10. Indemnification
You agree to indemnify, defend and hold harmless Ezendawo and its officers, directors, employees, agents, affiliates, and licensors from all claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

11. Governing Law & Dispute Resolution

11.2 Any disputes will be subject to the jurisdiction of the courts of South Africa.
11.3 If any provision is found invalid or unenforceable, it will be severed or modified to the extent necessary, without affecting the remaining provisions.
12. Severability & Waiver
12.1 If any term or provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions will continue in full force and effect.
12.2 Our failure or delay in enforcing a right or provision does not constitute a waiver of such right or provision.
13. Entire Agreement
These Terms (together with the Privacy Policy and any additional terms for specific services) constitute the entire agreement between you and us regarding the Site and supersede all prior or contemporaneous agreements.
